- To reserve the property, you should complete and sign the
Booking Form and return it with payment of the initial
non-refundable deposit. Following
receipt of the Booking Form and deposit, we will send a
Confirmation Statement.
For the avoidance of doubt, your agreement for the property rental is with
the Owner of the property. The following booking conditions confirm the
terms of this agreement and, in the event of a dispute, this should be
resolved with the Owner. French Country Houses Ltd accepts no liability for
any damages directly or indirectly suffered as a consequence of this
agreement.
- The balance of the rent, together with the security deposit (see
Clause 5), is payable not less than 8 weeks before the start of the
rental period. Reservations made
within 8 weeks of the start of the rental period require full
payment at the time of the booking.
- A security deposit is required in case of, for example, damage to
the property or its contents - this amount will be included in the
pricing details on the Booking Form. However, the sum reserved by
this Clause shall not limit the Client's liability to the Owner. The
Owner will account to the Client for the security deposit and refund
the balance due within 2 weeks after the end of the rental period.
- Subject to Clauses 1 & 2 above, in the event of a cancellation
refunds of amounts paid (excluding initial deposit) will be made if
the Owner is able to re-let the property. The Client is strongly
recommended to arrange a comprehensive travel insurance policy
(including cancellation cover) and to have full cover for the
party's personal belongings, public liability, etc, since these are
not covered by the Owners' insurance.
- The maximum number to reside at any time at the property must not exceed that
as indicated on the Booking Form (including all children), unless
the Owner has given written permission prior to arrival.
- The Client agrees to be a considerate tenant and to take good care
of the property and to leave it in a clean and tidy condition at the
end of the rental period. If the property is left in an
unacceptable condition, then the Owner will make a retention from
the security deposit to cover additional cleaning costs.
- The Client shall report to the Owner's Representative without delay any defects in
the property or breakdown in equipment, plant, machinery or
appliances in the property, gardens or swimming pool, and
arrangements for repair and/or replacement will be made as soon as
possible.
- Whenever the Client is absent from the property, the Client
undertakes to ensure all doors and windows are properly secured to
meet the Owner's insurance stipulations. Also, in the event of a
storm, the Client undertakes to unplug electrical appliances, such
as telephone/TV and music centre.
- The Owner shall not be liable to the Client for:
- any temporary defect or stoppage in the supply of public services
to the property, nor in respect of any equipment, plant, machinery
or appliance in the property, gardens or swimming pool
- any loss, damage or injury which is the result of negligence on
the part of the client
- any loss, damage or inconvenience caused to or suffered by the
Client if the property 'shall be destroyed or substantially damaged'
before the start of the rental period and in any such event, the
Owner shall, within 7 days of notification to the Client, refund to
the Client all sums previously paid in respect of the rental
property
- Under no circumstances shall the Owner's liability to
the Client exceed the amount paid to the Owner for the rental
period.
- In the unlikely event that
the Client needs to complain, he or she should contact the Owner's
Representative so
that he has the opportunity of settling grievances during the stay.
The Owner cannot accept complaints made after the Client has
returned home if he has not been given the opportunity to put
matters right during the Client's stay.
- The swimming pool will be open for use between mid-May
and mid-September each year. The property complies with the French
laws relating to pool safety and the client is responsible for
making themselves aware of the simple instructions which are in
place at the property.
This contract shall be governed by French law in every particular,
including formation and interpretation and shall be deemed to have been
made in France. Any proceedings arising out of or in connection with this
contract may be brought in any Court of competent jurisdiction in
France.
